New Perspectives on Herbal Supplements Related to law in Virginia and Maryland

Under existing U.S. laws, all dietary supplements sold domestically, including botanical supplements, are regulated by the Food and Drug Administration (FDA) under the Specialty Food Category.

The Food and Drug Administration (FDA) does not regulate dietary supplements the way that it regulates medicines. Many prescription drugs and over-the-counter medications are also made with plant products, but those products only have refined ingredients, and are regulated by the FDA. Products made from botanicals, or plants, used for treating diseases or for maintaining health are called herbal products, botanical products, or plant-based medicines. Dietary supplements include not only herbs and botanical products, but vitamins, minerals, amino acids, and some other nonprescription products that enhance the diet.

Dietary supplements are subject to stricter manufacturing and quality-control regulations than foods, and must thus be manufactured at CGM-compliant manufacturing facilities approved to manufacture dietary supplements. While it is completely legal to make your own tinctures, tea blends, and salves for sharing with friends and family, you need to comply with regulations in order to sell your plant-based products or medicines at retail or online. Product labels are a representation of both your personal aesthetics and the information you are required to provide consumers. House Bill 175 would amend the public health code to direct the commissioner of the Department of Public Health to require vaccination with the COVID-19 vaccine for persons who live or work at a residence-based healthcare facility. In addition, Senate Bill 267 would require the New Jersey Department of Health to create a program to reimburse health care workers and others who need the vaccine for out-of-pocket costs.

New York has created the Breastfeeding Mothers Bill of Rights, which is required to be posted at mothers healthcare facilities. Louisiana bans the application of a state sales or use tax on any consumers purchase of breastfeeding supplies. California, New York, Texas, Illinois, and Connecticut all have laws regarding human milk supply, processing, distribution, use, or reimbursement. In addition, the ACA requires that new private health plans, including plans offered on the new Health Insurance Marketplace, offer coverage of specified womens preventive health services without cost-sharing (e.g., copayments, coinsurance, or deductibles).

In less developed countries, herbal medicines are a major source of medical care. Generally, the traditional herbs used for their values are cheaper than newer, single-component drugs made with them.

How to leverage the value beyond 2 in screening the candidate drugs that are extracted from the herbal medicines to treat diseases, and also in discovering the novel uses for an older medicine, is the problem facing pharmaceutical industry and biotechnology companies. With new discovery of genes and proteins related to diseases, new drug targets would be made available to discover drugs from herbal medicines.
